AUCTION TERMS & CONDITIONS

Please ensure your phone number and email address are up to date and correct in your profile settings.

There will be a 10% Buyer’s Premium added to each final bid to determine the final sales price. All items must be paid for in full at the conclusion of the auction or on pickup day.

We will contact all winning bidders by phone or email on January 1, 2026, to confirm payment. If we are unable to contact you to confirm your form of payment, we will automatically process the credit card on file. You will receive an email with a copy of your “PAID” invoice.

Accepted forms of payment include cash, check, or major credit card. A 3.5% convenience fee will apply to all credit card payments. A 6% Kentucky sales tax will be added unless a valid resale tax-exempt certificate is provided at the time of payment.

ALL ITEMS ARE SOLD AS-IS, WHERE-IS. ALL SALES ARE FINAL.

CONDITION OF PROPERTY

All property is sold in “AS IS” and “WHERE IS” condition with no warranties expressed or implied. No refunds, exchanges, adjustments, or chargebacks will be allowed.

Property is available for inspection, and it is the bidder’s responsibility to determine condition prior to bidding. Failure to inspect any item shall not constitute grounds for any claim, refund, adjustment, or chargeback.

PICKUP & PAYMENT INFORMATION

Pickup Days:

Friday, January 2nd & Saturday, January 3rd, 2026: 9:00 AM – 5:30 PM

Accepted payment methods include cash, cashier’s check, personal or business check, and credit/debit card (3.5% processing fee).

All items must be paid for and removed by January 3, 2026, unless prior arrangements have been made. Any unpaid balances or unclaimed items after this date will be charged to the credit card on file with applicable processing fees.

Items not removed by the deadline may be discarded or resold at the Auctioneer’s discretion with no refund to the purchaser.

Container buyers: We will coordinate with you and your hauler to arrange a reasonable pickup time.

BIDDING & AUTO-EXTEND

This is a timed online auction ending January 1, 2026 at 2:00 PM.

An auto-extend feature is in effect. If a bid is placed within the final 3 minutes, bidding will extend an additional 3 minutes from the time of that bid. This process continues until no bids are received within a 2-minute window. Extend time may be adjusted at the Auctioneer’s discretion.

SERVER & TECHNICAL ISSUES

In the event of technical difficulties related to server, software, or online bidding platforms, Lawson Co. Auctioneers, LLC reserves the right to extend, continue, or close bidding as deemed necessary.

Neither the software provider nor Lawson Co. Auctioneers, LLC shall be held responsible for missed bids or software malfunctions.

LEGAL & AGENCY DISCLOSURE

Any dispute arising from this auction shall be tried exclusively in a court of competent jurisdiction located in Nelson County, Kentucky.

Lawson Co. Auctioneers, LLC, its agents, and representatives act as agents of the seller only. Buyers agree to hold harmless and indemnify Lawson Co. Auctioneers, LLC from any claims, damages, or legal actions.

Auction company employees and/or the auction company may bid on and purchase items.

BIDDER DEFAULT

Failure to complete a purchase constitutes a breach of contract. In the event of bidder default, Lawson Co. Auctioneers, LLC reserves the right to:

Pursue legal action
Revoke bidding privileges
Revoke bidding privileges across all MarkNet Alliance auctions

COMMUNICATION CONSENT

By registering, bidders agree to receive emails and text messages (Msg & Data rates may apply) regarding current and upcoming auctions.

If bidder credentials are compromised, the Auctioneer must be notified immediately.
